Terms and Conditions

PREMISE

The following text ("general conditions of sale") governs the terms and conditions of sale of the products marketed by Gianni Calzature (the "products"). All contracts for the sale of products by Gianni Calzature to third parties (the "customers") are governed by these General Conditions, which form an integral and substantial part of any proposal, order and confirmation of purchase of the products themselves. The conditions of sale applicable to the order are those in force on the date of the order itself.

Any changes relating to transactions or payment conditions granted in derogation from the General Conditions will be valid only if Gianni Calzature has accepted this condition in writing.

The General Conditions apply to all Customers, except certain provisions applicable exclusively to the Consumer Customer ("Consumer Customer" means a natural person who purchases the products for purposes unrelated to the entrepreneurial or professional activity possibly carried out); it is presumed that it is not "Consumer Customer" that Customer who sends a purchase proposal by entering his VAT share in the area related to the Customer’s personal data. The Purchase Contracts stipulated by Consumer Customers are also subject to Articles 50 to 63 of Legislative Decree. No. 206/2005.

Gianni Calzature may modify, at any time and without notice, the content of the General Conditions referred to in this document: these changes will take effect from the date of publication on the Site.

PURCHASE PROCEDURE

The order sent by the Customer has the value of a contractual proposal and implies full knowledge and acceptance of these General Conditions. The correct receipt of the Customer’s proposal is confirmed by Gianni Calzature by an automatic reply sent to the Customer’s e-mail address. This automatic email only confirms the correct receipt of the proposal. The confirmation message will indicate the 'Order Number', to be used in any subsequent communication with Gianni Calzature.

Each order is visible by the Customer in their personal area of the Site. As soon as the order is processed, the data contained within the personal area will be updated. Each Purchase Agreement between Gianni Calzature and the Customer shall be deemed to be concluded with the acceptance of the order by Gianni Calzature. Gianni Calzature has the right to accept or not, at its discretion, the order sent by the Customer, without the latter can make claims or rights whatsoever, in any way, including compensation, in case of non-acceptance of the order itself. The order is accepted by Gianni Calzature if, within 48 hours of sending the order, the Customer should not receive other communications. In case of non-acceptance Gianni Calzature will notify the customer by e-mail.

By sending the order, the Customer declares that he has read all the information provided to him during the purchase process, and fully accept the General Conditions and Payment described below.

PAYMENTS IN INSTALLMENTS

Payment in installments with Alma

Payment in installments/deferred payment is available through our partner Alma. Payment security is guaranteed by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases

* P2X : Only purchases between €50 and €2,000 are eligible to pay with Alma.

* P3X : Only purchases between €50 and €2,000 are eligible for payment with Alma.

* P4X : Only purchases between €50 and €2,000 are eligible to pay with Alma.

Commissions

By paying in installments with Alma the customer does not pay any commission.

Alma is an online payment manager and issues an electronic certificate which will be considered proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the Civil Code.

Cancellation

Any termination of the TOS between the Seller and the customer will result in the termination of the TOS between Alma and the customer.

PRICES OF PRODUCTS - DELIVERY COSTS - AVAILABILITY OF PRODUCTS

All prices of the products are clearly indicated on the Site and are inclusive of VAT. They shall not include any other taxes, duties or duties provided for in the relevant legislation applicable in the case of importation.

In this case, the Customer must arrange to clear the products by paying the duties and taxes (other than VAT) possibly due in the country of import. The prices and availability of the products shown on the Site are subject to change at any time and without notice, provided that, limited to the orders being accepted or already accepted by Gianni Calzature, the conditions of sale in force at the time of sending the order by the Customer will apply.

The availability indicated in the product sheets is not updated in real time; in the event that numerous accesses to the site, the actual availability of individual products may vary significantly during the same day compared to the indications on the Site. In virtue of these variables Gianni Calzature does not guarantee, therefore, the certainty of immediate delivery of the products purchased and indicated as available on the Site and therefore it will not be responsible for any delays in delivery.

For payments by bank transfer, Gianni Calzature will send the products only when the relevant amount will be credited to the current account headed to Gianni Calzature.

If the delivery time of the ordered product is delayed compared to the delivery time indicated on the Site before the order, Gianni Calzature undertakes to give prompt notice to the Customer via an e-mail message. Until the moment of shipment, the Customer has the right to cancel or modify the order, exclusively following the procedures indicated in his personal area. The cost of each shipment, the amount of which may vary depending on the method of delivery and payment as well as the country of destination and the total amount of the order, is added to the total price of each purchase and is clearly indicated and communicated to the Customer before the conclusion of the Purchase Contract, within the Site.

The visual representation of the products on the Site, where available, normally corresponds to the photographic image of the products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, by Gianni Calzature, about the exact correspondence of the image depicted on the Site with the actual product (with particular reference to the actual dimensions and/or chromatic aspects of the products).

RIGHT OF WITHDRAWAL

The consumer, you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days starting from the day of receipt of the products purchased on www.giannicalzature.it.

In this case you will receive a full refund of the price of the purchased products.

You must return the products to the Seller in the same conditions in which you received them and with the return label received by the seller. You are legally obliged to take care of the products while they are in your possession. If you don’t, we’ll have a chance to challenge your refund request.

To exercise your right of withdrawal, you must follow these steps:

A. Within fourteen (14) working days of receipt of the products, complete and submit the return request online 

B. The products must not have been used, worn, washed or damaged;

C. The identification tag must still be attached to the products;

D. Products must be returned in their original packaging;

E. Returned products must be delivered to the shipper within fifteen (14) days from the date you requested return authorization.

After completing the return process, we will refund the same as soon as possible, at the latest within 30 days from the moment you cancelled the order.

Shipping costs are borne by the customer.
